1. Provider and Scope

These Terms of Service (“Terms”) govern the use of the mobile application Gooodie.

By accessing or using Gooodie, you agree to be bound by these Terms.

2. Description of the Service

Gooodie is a digital platform that enables users to:

  • participate in interactive quests
  • create and manage quests
  • submit photos, videos and text as part of quests

The app is currently provided free of charge.
We reserve the right to modify or discontinue features at any time. Content can be deleted at any time.

3. Account Types and Access

Users may access Gooodie:

  • as registered users (email/password or social login), or
  • anonymously with limited functionality.

You are responsible for:

  • keeping your login credentials secure
  • all activities carried out under your account.

4. User-Generated Content

Users may upload:

  • photographs
  • videos
  • text
  • other quest-related submissions.

You confirm that:

  • you own all necessary rights to the content, or
  • you have obtained permission from the rights holder.

You grant Gooodie a non-exclusive, worldwide, royalty-free licence to store, process and display the content solely for the purpose of operating the service.

5. Visibility of Quest Content

By submitting content to a quest, you acknowledge and agree that this content will be accessible to:

  • the quest owner, and
  • other participants of that quest.

Access to quests is typically controlled via quest codes.
We do not guarantee that quest content cannot be accessed by third parties who obtain them without authorisation.

6. Prohibited Content and Conduct

It is strictly prohibited to upload or distribute content that:

  • is pornographic or sexually explicit
  • depicts violence or gore
  • is discriminatory, hateful or harassing
  • is unlawful
  • infringes intellectual property or personal rights
  • violates applicable laws.

7. Rights of Quest Creators and Use of Resources

All quests and their content remain the intellectual property of their respective creators.

You are not permitted to:

  • copy
  • reuse
  • extract
  • distribute
  • make available to third parties

any quest, media, or other resources without the explicit consent of the creator.

8. Reporting, Moderation and Enforcement

We reserve the right to:

  • review reported content or behaviour
  • remove content
  • restrict access to quests
  • suspend or terminate user accounts

where:

  • these Terms are violated, or
  • this is necessary to protect users or the platform.

9. Participation at Your Own Responsibility

Participation in quests may involve activities in real-world environments.

Users are solely responsible for:

  • their safety
  • their behaviour
  • compliance with local laws and regulations.

Gooodie does not provide any guarantees regarding:

  • locations
  • conditions
  • third-party environments.

10. Availability of the Service

We strive to provide a reliable and secure service.
However, we do not guarantee uninterrupted availability or error-free operation.

Maintenance, updates, or technical issues may result in temporary interruptions.

11. Limitation of Liability

To the extent permitted by law, Wildcard GmbH shall not be liable for:

  • user-generated content
  • misuse of quest codes
  • unauthorised access by third parties
  • loss of data caused by user actions
  • temporary unavailability of the service.

Liability for intent and gross negligence remains unaffected.

12. Termination

You may delete your account at any time.

We may suspend or terminate accounts if:

  • these Terms are violated
  • unlawful activities occur
  • there is misuse of the platform.

13. Changes to the Terms

We may amend these Terms from time to time.

The current version will always be available online at gooodie.app and within the app.
Continued use of the app constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by Austrian law, excluding conflict-of-law rules.

The competent court at the registered office of Wildcard GmbH shall have jurisdiction, to the extent permitted by law.
